Roth Bill Update

    Hey all,

    The Roth bill has passed out of the House, but is now in the Senate Transportation Committee and is on the calander to be vote on this coming Wednesday.

    It looks like Rep. Overby, the house sponsor, has done a very good job rounding up support in the house, as the bill has 21 house sponsors. On the Senate side though, the TN Legislature site only reports that it has one sponsor, the prime sponsor, Sen. Roy Herron (although the News Sentinel did report that Sen. Tim Burchett is a co-sponsor as well as did the Maryville Daily Times for Sen. Finney). Getting out of committee is the biggest hurdle legislation has, once it gets out of committee bills have a easier chance of passing. It helps to have some co-sponsors on the committee, as it did in the house side. Sen. Jaime Woodson, one of our Knoxville Senators, is on the Senate Transportation Committee.

    I think it would be worthwhile to contact Sen. Jaime Woodson and ask her both to vote for the bill when it comes before her and to co-sponsor it. I don't know where she stands at the moment, but even thought this doesn't appear to be a controversial bill if she hears from lots of folks in her district about why this bill is meaningful to you it will help.

    Bill Summary for SB1699 / *HB0235

    This bill adds to the present law "rules of the road"
    by requiring the operator of any motor vehicle to
    leave a safe distance between the vehicle and a
    bicycle when passing a bicycles that is proceeding in
    the same direction. Any violation of this bill is a
    Class C misdemeanor.

    ON MARCH 12, 2007, THE HOUSE ADOPTED AMENDMENT #1 AND
    PASSED HOUSE BILL 235, AS AMENDED.

    AMENDMENT #1 clarifies that this applies to motor
    vehicles overtaking and passing a bicycle and requires
    that the motor vehicle operator leave at least three
    feet of distance.

    FYI:
    • Between 1986 and 1995, an total of 108 bicyclists (11 per year) were struck and killed by motor vehicles in Tennessee. And for every bicyclist killed by a car, another 88 suffer injuries -- for a total of 950 bicyclists injured by cars each year in Tennessee.

    • A significant number (80 percent) of all bicyclists killed by cars in Tennessee are killed in their neighborhoods, on local roads, collectors streets, and minor arterials.

    • 64.8 percent of all bicycle fatalities in Tennessee involved children under the age of 18 -- a total of 70 fatalities in the last ten years.

    • Many children are also injured; for every child on a bike who is killed by a car another 100 are injured, for a total of 700 children injured by cars while bicycling in Tennessee each year.

    Lastly...

    The real goals are to make bicycling more accessible and safer. The city of Davis, California provides an example of how this can be done. Davis began considering bicycle use and bicycle safety years before ISTEA was passed in 1991. The city has built many miles of bike trails and lanes, implemented education and enforcement campaigns, and aggressively acted to reduce risks. As a result, more than 20 percent of trips in Davis are made by bike (many times higher than the national average), and children ride everywhere. Over the past ten years, no one has been killed in Davis California while riding a bicycle, proof that increased ridership and increase safety can go hand in hand.

    According to the Bill History Section, from what I can tell, the Senate substitued the House bill (for it's own SB1699) after voting Ayes 8, Nays 0 on 4/4/07 for the new law. Meanwhile, the House voted Ayes 30, Nays 0 on 4/9/07.

    Yet, I've heard n-o-t-h-i-n-g else and can't turn ANYthing up on it in the press.

    Also, I'm amazed :shocked: that there is so little discussion on any of the cycling forums in Tennessee about this.​

    AD is right, I looked up the Roth bill on Google and RRI is there. We will take any kind of exposure we can get right now!
